2. Information We Collect

Depending on how you interact with us, we may collect contact information such as your name, email address, telephone number, and mailing or billing address; reservation, order, catering and private-event information; information needed to process payments through third-party providers; information you submit through contact, catering, event, reservation, ordering, newsletter, survey, promotion, or other forms; technical and device information such as IP address, browser type, device characteristics, operating system, referring URLs, approximate location derived from IP address, and interactions with our website; and information collected through cookies and similar technologies.

3. How We Collect Information

We collect information when you submit a form, contact us, make or request a reservation, place an order, request catering or private-event services, subscribe to communications, participate in a promotion or survey, or otherwise interact with our services. We may also receive information through third-party services used for reservations, ordering, catering/event lead management, analytics, communications, hosting, and payments.

4. Cookies and Similar Technologies

Our website may use cookies, pixels, tags, scripts, SDKs, and similar technologies to operate the website, remember preferences, understand website usage, measure performance, and support analytics or marketing. We currently use Google Analytics 4 for website analytics and measurement. We do not currently display a cookie-consent banner on the website. Users may control cookies through their browser settings. If our use of non-essential tracking technologies changes, we may update this Policy and implement any controls required by applicable law.

5. Third-Party Services

We use third-party providers to support our business and website, including: OpenTable for restaurant reservations; Toast for online ordering and payment-related restaurant services; Breadth Marketing for catering and private-event lead generation, inquiry management, and related follow-up; Google Analytics for website analytics and measurement; Contact Form 7 for certain website contact forms; and WordPress and related hosting/site services for website operation. These providers may collect or process information under their own privacy policies and contractual arrangements. When you interact directly with a third-party service, that service may collect information subject to its own terms and privacy policy.

6. How We Use Personal Information

We may use personal information to provide, operate, maintain, and secure our website and services; process reservations, orders, inquiries, catering requests, and private-event requests; communicate with you about reservations, orders, requests, services, and customer support; send marketing or promotional communications where permitted by law; improve our website, services, menus, events, and customer experience; analyze website usage and performance; detect, prevent, investigate, and address fraud, security incidents, misuse, and technical problems; and comply with legal obligations and enforce our agreements.

7. Marketing Communications

Where permitted by applicable law, we may send promotional or marketing communications. You may opt out of marketing emails by using the unsubscribe mechanism included in the communication or by contacting info@CalaMillorMiami.com. Opting out of marketing communications does not necessarily stop service-related or transactional communications. Commercial email communications must comply with applicable federal requirements, including accurate sender information, non-deceptive subject lines, a valid physical postal address, and a functioning opt-out mechanism.

8. Disclosure of Information

We may disclose personal information to service providers, processors, and business partners that help us operate our website and business, including providers supporting reservations, ordering, catering/event lead management, analytics, hosting, communications, and payment processing. We may also disclose information when required by law, legal process, or governmental request; when reasonably necessary to protect our rights, property, customers, users, or the public; or in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, subject to applicable law.

9. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to provide services, maintain business and transaction records, resolve disputes, comply with legal obligations, prevent fraud, and enforce agreements. Retention periods may vary depending on the type of information and the purpose for which it was collected.

10. Privacy Requests

Depending on where you live and which law applies, you may have privacy rights such as access, correction, deletion, portability, or other rights provided by applicable law. To submit a privacy request, contact info@CalaMillorMiami.com. We may verify your identity before completing a request and will apply the deadlines and procedures required by the law applicable to the requester.

11. Florida Privacy Law

CalaMillor is not presenting itself as subject to the Florida Digital Bill of Rights solely because it operates in Florida. The current Florida definition of “controller” requires, among other elements, more than $1 billion in global gross annual revenues plus at least one specified additional condition. Based on the information provided for this Policy, CalaMillor does not meet that $1 billion threshold. If the company’s structure, revenues, ownership, or activities change, this analysis should be reassessed. Other Florida laws may still apply depending on actual practices.

12. Federal Privacy and Children’s Privacy

There is no single comprehensive federal consumer privacy statute governing all of CalaMillor’s website data. Federal requirements may apply to particular activities, including the Federal Trade Commission Act, the CAN-SPAM Act for commercial email, and the Children’s Online Privacy Protection Act (COPPA) where its requirements are triggered. Our website and services are not directed to children under 13. If we have actual knowledge that we collect personal information online from a child under 13 in circumstances covered by COPPA, we will follow applicable COPPA requirements.

13. Data Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, use, alteration, disclosure, or destruction. No method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

14. Third-Party Websites and Services

Our website may contain links, integrations, embedded functionality, or services provided by third parties. Those third parties may collect and process information under their own privacy policies and terms. We encourage users to review the privacy practices of third-party services before providing personal information.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, services, technology, legal requirements, or other circumstances. We will update the “Last Updated” date when changes are made and provide additional notice or obtain consent where required.
